Welcome to PsySim. These Terms & Conditions ("Terms") govern your access to and use of the PsySim platform, including our website, AI-driven clinical simulations, learning activities, and any related services (collectively, the "Service"). By creating an account or using the Service you agree to be bound by these Terms.

PsySim is an educational tool designed for psychology students, trainees, and professionals. It is not a substitute for real therapy, clinical supervision, or professional medical advice.

We take your privacy seriously. Account information and practice sessions are stored securely and are used to provide the Service, generate feedback, and show your growth over time. We do not sell your personal data to third parties.

Anonymized and aggregated usage data may be used to improve the quality of our AI models and learning materials. You can request deletion of your account and associated data at any time by contacting us.

You agree to use PsySim responsibly and in accordance with all applicable laws and professional ethical standards. In particular, you agree to:

• Provide accurate account information and keep your credentials secure.
• Not use the Service to seek diagnosis or treatment for a real medical condition.
• Not upload confidential patient information or personally identifying data of third parties.
• Not attempt to reverse engineer, disrupt, or misuse the Service.

For the purposes of these Terms, "Intellectual Property Owner" means the person or legal entity that owns the Intellectual Property associated with the Service.

All intellectual property rights relating to the Service, including but not limited to its software, source code, object code, software architecture, AI models, algorithms, clinical simulation engine, prompts, evaluation methodologies, workflows, business logic, databases, data structures, APIs, user interface (UI), user experience (UX), graphics, original content, educational materials, documentation, trademarks, logos, trade names, audiovisual materials, current and future features, and any updates, improvements, derivative works, or related components (collectively, the "Intellectual Property"), are owned by the Intellectual Property Owner, unless expressly stated otherwise.

The Service is developed, operated, and commercially managed by POTENTIA APOIO ADMINISTRATIVO LTDA - ME (CNPJ 61.579.102/0001-06), a legally incorporated entity acting under authorization from the Intellectual Property Owner. Such operation does not constitute, and shall not be interpreted as, a transfer, assignment, waiver, or license of any Intellectual Property rights.

The Intellectual Property is protected by applicable copyright, trademark, trade secret, unfair competition, and other intellectual property laws.

Without prior written authorization from the Intellectual Property Owner, you may not:

• Copy, reproduce, distribute, modify, or create derivative works based on any part of the Service.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code, AI models, algorithms, prompts, system architecture, or underlying technology.
• Scrape, extract, harvest, replicate, or reuse databases, datasets, workflows, simulation structures, AI outputs, or other technological components through automated or manual means.
• Use bots, crawlers, web scraping tools, or similar technologies to access or collect information from the Service.
• Use any part of the Service, including its content, simulations, prompts, or outputs, to train, fine-tune, benchmark, or improve any artificial intelligence or machine learning model without prior written permission.
• Remove, alter, or obscure any copyright, trademark, or proprietary notices displayed within the Service.

The clinical simulations, patient personas, conversation structures, educational methodologies, assessment frameworks, scoring systems, prompts, feedback mechanisms, AI workflows, and other proprietary learning resources available through PsySim constitute valuable Intellectual Property and, where not publicly disclosed, may also constitute confidential trade secrets.

Participation by the Intellectual Property Owner or the Service operator in competitions, accelerators, research collaborations, investor meetings, commercial demonstrations, conferences, public presentations, or similar activities, as well as the publication of marketing or technical information about the Service, does not constitute a waiver of any Intellectual Property rights, trade secret protection, confidentiality obligations, or any express or implied license to use, reproduce, exploit, or replicate the underlying technology.

You retain ownership of the text you create during your simulations. By using the Service, you grant PsySim a limited, non-exclusive license to process that content solely for the purpose of providing the Service, generating feedback, maintaining your learning history, and improving the platform through anonymized and aggregated analysis where applicable.

Any authorization to use the Intellectual Property must be granted expressly in writing by the Intellectual Property Owner. Nothing in these Terms shall be interpreted as granting any express or implied license or as transferring ownership of any Intellectual Property rights.

Any unauthorized use of the Intellectual Property may result in the suspension or termination of your access to the Service and may also give rise to civil, administrative, or criminal remedies under applicable law.

Certain features are available through PsySim Premium, a paid subscription. Prices, billing cycles, and included features are described at the point of purchase. Subscriptions renew automatically unless cancelled before the end of the current billing period.

Refunds are handled on a case-by-case basis in accordance with applicable consumer protection law. You are responsible for any taxes that apply in your jurisdiction.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, PsySim disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

PsySim shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of — or inability to use — the Service.

We may update these Terms from time to time to reflect changes in the Service or in applicable law. When we make material changes we will notify you through the Service or by email. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
